This End-User License Agreement (“EULA”) is a legally binding contract between you and Nebula App Development LLC (“we,” “us,” or “our”) and governs your use of any software, mobile applications, digital tools, or related content provided by Nebula App Development LLC (collectively referred to as the “Software”).
This EULA applies to all software products and applications developed by Nebula App Development LLC, unless a separate license agreement is provided with a specific product and expressly overrides these terms.
By downloading, installing, or using any of our Software, you acknowledge that you have read, understood, and agree to comply with the terms outlined in this EULA. If you do not agree to these terms, we kindly ask that you refrain from using the Software and remove it from your device.
License and Intellectual Property Rights
Subject to your full compliance with the terms of this EULA, Nebula App Development LLC grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Software solely for personal, non-commercial purposes.
All rights, title, and interest in and to the Software, including all related intellectual property, remain the exclusive property of Nebula App Development LLC. The Software is protected by applicable copyright, trademark, and other intellectual property laws. You are strictly prohibited from modifying, reproducing, reverse engineering, distributing, or creating derivative works of the Software without our prior written consent.
Prohibited Uses
You agree not to engage in any of the following activities:
Updates and Modifications
Nebula App Development LLC may, from time to time, provide updates, upgrades, enhancements, or modifications to the Software. Such changes may be implemented automatically or may require you to take specific action to complete the installation. Your continued use of the Software following the release of any updates shall constitute your acceptance of any modified terms associated with those updates.
Disclaimer and Limitation of Liability
The Software is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Nebula App Development LLC expressly disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no representation or guarantee that the Software will be uninterrupted, error-free, or meet your specific requirements.
To the maximum extent permitted by applicable law, Nebula App Development LLC shall not be held liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your access to or use of the Software. In all circumstances, our total cumulative liability shall not exceed fifty U.S. dollars (USD $50).
Termination
This End-User License Agreement shall remain in effect until terminated by either party. You may terminate this Agreement at any time by discontinuing use of the Software and removing it from your device. Nebula App Development LLC reserves the right to terminate this Agreement immediately, without notice, if you fail to comply with any of its terms or conditions.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Georgia. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Georgia.
